1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of bkempreendimentos.online and any SaaS platform, AI tool or infoapp made available by BK Empreendimentos e Negócios Digitais LTDA ("BK", "we", "us"), CNPJ 47.786.930/0001-86. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Description of the Services

BK builds and operates SaaS platforms, AI-driven automation and infoapps for customers globally. Specific products may be subject to additional terms, order forms or subscription agreements, which take precedence over these Terms in case of conflict for that specific product.

3. Accounts and eligibility

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must be legally capable of entering into a binding contract in your jurisdiction to use our Services.

4. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable regulation
• Attempt to gain unauthorized access to our systems, other accounts or underlying infrastructure
• Reverse engineer, decompile or attempt to extract the source code of our software, except where permitted by law
• Use automated means to scrape, overload or disrupt our Services
• Resell, sublicense or redistribute the Services without our prior written consent

5. Subscriptions, billing and payments

Paid plans are billed in advance on a recurring basis unless otherwise stated at checkout. Prices are shown in the currency displayed at the time of purchase and may be updated from time to time, with reasonable advance notice for existing subscribers. Failure to pay may result in suspension or termination of access. Refunds are handled according to our Refund Policy.

6. Intellectual property

All software, designs, trademarks, content and materials that make up our Services are owned by BK or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights — only a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

7. Your content

You retain ownership of any content, data or material you submit to our Services. By submitting it, you grant BK a limited license to host, process and display that content solely to provide and improve the Services.

8. Service availability

We aim to keep our Services reliable and available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services, with reasonable notice where practical.

9. Limitation of liability

To the maximum extent permitted by applicable law, BK shall not be liable for indirect, incidental, special or consequential damages arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or misuse the Services, with notice where reasonably possible.

11. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be submitted to the competent courts of Cuiabá, Mato Grosso, Brazil, without prejudice to any mandatory consumer-protection rules applicable in your country of residence.

12. Changes to these Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
